There is another aspect of the Special Assessment vote that I believe deserves transparency: the receipt, validation, custody, counting, and certification of the ballots.

Owners were given a deadline of July 6, 2026 at 5:00 P.M. to submit their ballots. The results were not communicated to the community until August 7, 2026, more than a month later.

A delay between a voting deadline and the announcement of results does not, by itself, establish that anything improper occurred.

However, given the significance of this assessment and the close 25–23 result, I believe Owners should be able to understand and independently verify how the ballots moved from submission to certification.

The Association has reported that:

57 ballots were received

48 ballots were determined to be valid

25 valid ballots voted in favor

23 valid ballots voted against

Those numbers answer several of the questions I initially had.

They also leave several others unanswered.

Were all 57 ballots received by the July 6, 2026 at 5:00 P.M. deadline?

If any ballots were received after the deadline, were any of those ballots included among the 48 valid ballots counted?

Why were nine ballots excluded?

Were those ballots submitted by Owners who were not eligible to vote, received after the deadline, incomplete, duplicates, defective in some other respect, or excluded for another reason?

There may be entirely legitimate explanations. Identifying the reason for each exclusion would allow the final count to be reconciled.

When were the ballots actually reviewed and counted?

On what date were the ballots opened, reviewed for eligibility, tabulated, and certified?

Who participated in that process?

Besides Mr. Simmonds. Who received the ballots? Who maintained custody of them? Who determined which ballots were valid? Who counted them? Who certified the final result?

Was the Association's professional management company involved?

If so, what role did management play in receiving, maintaining, validating, counting, or certifying the ballots?

Is there a contemporaneous ballot record?

Does a ballot log, tally sheet, certification, email record, or similar document exist showing when ballots were received, which were accepted or rejected, and how the final 25–23 result was reached?

These questions do not presume wrongdoing.

Nor does the month between the voting deadline and announcement of the results establish that anything improper occurred.

The purpose is much simpler.

A vote resulting in a financial obligation being imposed upon the community should have a record sufficient to reconstruct the result:

The Association has provided the beginning and end of that process. I am asking for the records that document what happened in between.
